This site has three types of users – location owners who post photographs of their property on the site for filming, location professionals who register to access the location information, and affiliates who refer customers to the website. These Terms & Conditions apply to these three types of users. Any user who uses this site agrees to abide by all of the Terms & Conditions set forth below. From time to time, Madisonlocations.com may amend the Terms & Conditions without advance notice to you. The amended Terms & Conditions shall become effective immediately upon posting on the website.

Site’s Purpose:
The purpose of the site is to allow location professionals to contact location owners directly to negotiate film location rentals. For a nominal fee, location owners can post and upload photographs and information about their property onto the site. Location professionals can register to access the site’s content for no charge. Affiliates can refer customers and receive commissions for paying registrations.

Restricted Use:
If you are a registered user, you agree that you will not share, sell, transfer or disclose your password or the site’s content to third parties or for any unauthorized purpose. If you do, your rights as a registered user will be immediately terminated and you will be held accountable for any resulting damages.

Site Content:
You agree that if you post or upload any content onto the site, you shall be solely liable for such content. Site users understand that the site’s content (including text, data, photographs, video and messages) may have been posted by a person or entity unrelated to Madisonlocations.com. Therefore, Madisonlocations.com does not warrant or guarantee the accuracy, integrity or quality of the content. Further, Madisonlocations.com reserves the right to remove any content that is illegal, inaccurate, defamatory or otherwise objectionable without refunding the owner.
No reference to or listing of another web site is allowed without prior written agreement and/or additional payment.

Posting, Transmitting and Using Content:
You agree not to upload, post or otherwise transmit any content that you do not have the rights to transmit such as stolen information, inside information, or proprietary or confidential information. You agree not to reproduce, duplicate, sell, rent, exploit any portion of the services or content provided on or through the site without the prior written consent of Madisonlocations.com.

Ownership of Content:
Madisonlocations.com does not claim ownership of the content uploaded onto the site by location owners. By submitting content to Madisonlocations.com, you grant to Madisonlocations.com a world-wide, royalty-free and non-exclusive license to reproduce, modify, adapt and publish the content on the site. The license will continue until you send an e-mail to contact@madisonlocations.com requesting that the license be terminated. All content posted onto the site by Madisonlocations.com is the sole and exclusive property of the company.

Limitation of Liability:
Madisonlocations.com is not liable for the misuse of its site or a user’s reliance on the site. It does not guarantee that a user will find an acceptable location or that a location owner’s property will be chosen for filming. Madisonlocations.com is not responsible for any negotiations or transactions which take place between location owner and any location professional. All users agree to use the site at their own risk. The site is provided on an “as is” basis, without warranties of any kind.
ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnification:
You agree to indemnify, protect, defend and hold harmless Madisonlocations.com and its owners, officers and employees from any claim, demand or damages, including attorneys’ fees, made by any third party for any matter arising out of or relating to your use of the site or location negotiations.

Membership Term:
The term of your membership begins on the date that you register as a member of Madisonlocations.com and will continue until we cancel your membership or your membership expires. You understand that terminating your membership is your sole remedy with respect to any dispute that you may have with Madisonlocations.com. There will be no refunds of membership fees unless agreed upon by Madisonlocations.com.

Limitation on Disputes:
Any dispute against Madisonlocations.com must be brought within one (1) year after such claim or cause of action arose or be forever barred. Such claim shall be filed as an arbitration proceeding in Los Angeles County, California, before the American Arbitration Association.

Charges:
There are no charges to location professionals to register to use the site. For location owners, the fees are set forth below:

Photo session (1st hour inc. 50 photos) $95

Standard Location Listing (1 year membership) $195

Featured Location Listing (1 year membership) $295

* Fees for uploading directly onto the site must be paid for in advance on-line by credit card. Other charges can be paid for now or at the time of the photo session.

Photographs Taken By Madisonlocations.com:
By hiring Madisonlocations.com to take the photographs for the website, location owner authorizes Madisonlocations.com to enter onto the property to take photographs and to forward the photographs to location companies/scouts. All such photographs (including negatives and reprints) shall be the sole and exclusive property of Madisonlocations.com.
